Would you crack an Xbox game after buying it on PlayStation? No, so don't do it for FMM. It isn't the game's fault they are two different stores.

He has purchased the right to use a piece of software, and this right includes the ability to take any and all steps required to use said software. If he needs to download a version from somewhere other than the playstore, he has the legal right to do so. SI might not like it, but this is EU Law and they could never make it stand up in court.

 

Also, to phrase it as you did makes it seem like the onus to be without roughly £10 should be on the one person who potentially can't afford it, as opposed to the successful company who most definitely CAN afford to be without a single £10 purchase. Morally, your high horse is on some rather dubious looking ground there.

The game is on two different stores making them different games. Exactly the same as PS4 and Xbox One. You have to purchase one for each as that is what you get the license for, not both. So this EU Law you are referring to doesn't cover this distribution.

 

Plus it isn't SI's fault he has changed device with a new store. If he can afford a new phone he can afford the game again.

Actually, the same law does indeed apply to xbox and ps4 games, it's just not widely known because most people wouldn't want to trade off an exclusion from the online services provided by sony and microsoft. They reserve the right to withdraw these services from any player at any time, so whilst legally you can crack an xbox game you own a ps4 copy of, legally they can ban you from xbox live. But this isn't xbox and ps4 anyway, this is far more like windows and mac. Legally, he would be allowed to modify the code to make a windows product work on a mac, and all the crack does is alter the code to tell the game you've paid for the licence, so he's well within his legal rights to do so. He bought FMM16, so he can play FMM16, end of.

 

And to suggest he can afford to buy precisely the same product twice because he can afford a new phone is once again a stretch. How do you know he hasn't simply had an upgrade on an existing contract, thus providing him with a new phone that he hasn't had to shell out for?

You are full of hot air. That isn't how the law works at all as he bought the FMM game for iOS which is a seperate game to the Android one. Modifying the game code is against EULA. When you purchase a digital game you purchase a license, that license states it is for that operating system only.
